The "Discipline and Discharge" Tactic

Some employers will progressively discipline employees who have suffered work injuries, eventually discharging them altogether.

If an employer can successful prove that an employee was discharged for reasons that are unrelated to the work injury, the employee is not entitled to receive workers’ compensation benefits. Employees who otherwise had completely clean records in their years with the employer suddenly find that they are being disciplined for minor rules infractions.
